Introduction

The website www.finhaatwealth.com and the mobile application ‘Finhaat Wealth’ (collectively referred to as the “Platform”) is owned and operated by Finhaat Wealth India Private Limited, a private limited company having its registered office at B-702, Om Harmony Pl- 267, Sec- 10, Kharghar, Raigarh, Mumbai, Maharashtra, India- 410210, referred to as “Finhaat Wealth”, “FW” “Company”, “We”, “Us” or “Our”.

FW distributes a range of both financial and other investment based non-financial products (collectively “Products”) including but not limited to mutual funds, digital gold, gold jewelry on EMI, which are offered / distributed by FW in its capacity as an intermediary/ agent of selected mutual funds/ asset management companies (“AMCs”)/ non-banking financial companies/ other third-party service providers/ vendors (“Product Providers”). FW provides services/ facilities (“Services”) on the Platform which enable(s) you/ the user (“You” “Client” “Customer” “Your”) to transact in Products including place investment request(s) or purchase or switch or redeem Products on the Platform as well as review Your investment dashboard.

By using (including visiting and accessing) the Platform and/ or availing the Services, You accept and agree to be bound by the terms and conditions of this privacy policy (“Privacy Policy”). This Privacy Policy is incorporated into and subject to the terms of use of the Platform (“Terms”) and shall be read harmoniously and in conjunction with the Terms.

In order to avail any Service on the Platform, You are required to complete FW's registration process and create a FW account (“Your Account”) by providing Your complete information/ documents including Personal Data (defined below) as per the Know-Your-Client (“KYC”) verification process in accordance with FW’s internal verification guidelines as well as the KYC guidelines issued by the Securities and Exchange Board of India ("SEBI") and/or Reserve Bank of India (“RBI”) and/ or any other regulatory body/ government agency or authority.

Accordingly, as a part of Your Account opening/ onboarding process you will be required to:

provide / update Personal Data;
authorise FW to fetch Personal Data one or more of the KYC Registration Agency (“KRA”);
authorise FW/ KRA to verify Personal Data;
authorise FW to share Personal Data with Product Providers; and
authorise FW to otherwise deal with/ handle Personal Data.

“Personal Data” refers to personal data and sensitive personal data contained in various identity documents that enables the identification of a person and consists of the following (and shall include any updated data of the following items from time to time): (a) person’s full name, including surname, given name and other name; (b) email address; (c) mobile phone numbers; (d) Unique Govt IDs; (e) Address. It is clarified that Personal Data does not include the Data that is freely available or accessible in the public domain.

It is only once you provide your specifical consent in this regard that Your Personal Data will be collected, used, stored, dealt with, handled and disclosed in accordance with this Privacy Policy.

This Privacy Policy outlines the manner in which FW collects, receives, stores, uses, discloses, safeguards and otherwise deals with or handles data including Personal Data when you avail of Services or interact with FW through the Platform.

FW is governed by the provisions of applicable laws in India including the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and such other rules/regulations and laws (collectively hereinafter referred to as “Applicable Law(s)”), as may be applicable and amended from time to time.

Your privacy is of utmost importance to FW and the protection of your Personal Data is a key commitment for FW.

2. INFORMATION THAT YOU PROVIDE TO US/ WE COLLECT

Data / information that FW may collect from you includes, but is not limited to, the following:

Personal Data such as your name, mobile number, email address, residential address, date of birth through either manual entering by You or through an upload of documents such as passport, adhaar card, PAN card, voter’s ID, driver’s license, and/or educational documents or details provided by You to FW;

Demographic information such as gender, income, occupation information, father’s and mother’s name, beneficiary, nominee details;

Your details including transaction history, balances and payment details, for effecting transfer of monies through various payment channels facilitated by FW;

Financial details (e.g. income, expenses, net worth, and/or credit history) needed as part of the request for some of FW’s Products/Services;

Uploaded images or videos of documents or self, required to avail any of FW’s distributed Products/Services;

Recordings of the interaction or communication via email, online chat, WhatsApp, surveys, chatbot, other social media interactions;

Details of employment and income proof including occupation, employer name, positions held, employment history, salary and/or benefits, if any, as part of FW’s record retention for credit / various product evaluations or as required under applicable law including Prevention of Money Laundering (Maintenance of Records) Rules, 2005 and other anti-corruption laws;

Specimen signature(s) or consent for the processing of your instructions received by FW through the FW’s various payment and delivery channels;

Other non-personal information/ data such as the device, the browser, the operating system being used to access website or mobile app; location, IP address, device manufacturer, and other unique identifiers of the device; information collected via cookies, pixel tags or similar electronic tools on our websites and emails.

2.HOW WE USE YOUR INFORMATION

Subject to applicable laws, we may use your Personal Data and other information in a fair and a reasonable manner in our business operations with a view to provide our Services or facilitate the provision of services by the Product Providers through our Platform and to perform, among other actions, the following:

To complete Your Account opening/ onboarding/ registration process to access the Services and to auto populate relevant fields in the course of Your interface with FW’s Platform including the completion of the KYC verification process on the Platform and document authentication in order to avail Services on the Platform including:
1. To verify Your identity by classifying identity documents and using optical character recognition technology, automatically extract human-readable data from the identity documents so provided;
2. To verify the likelihood that the identity information/ document provided is genuine and, if applicable, cross-reference the information written on the document with the validated identity;
3. To compare the face displayed on an identity document with any other image of a face, to verify that they are the same;
4. To process/match with any formula, algorithms or the database of the Data User;
5. To disclose the results of the verification to any other third parties;
6. To use and process the matching results for (i) assessing/ascertaining the veracity and authenticity of the documents so provided by You (ii) identifying suspicious/detecting fraudulent activities through the device used (iii) analytical and (iv) statistical purposes;
To store, use and transfer and share Your Personal Data with data users identified at 3 below and onward transmission by them from time to time to other transferees as applicable.
To use and store the Personal Data for any/all of the above purposes and/or create a pool/database of the information so collected.
use the Personal Data to contact You for making generalized and/or specialized offers.
To facilitate the transactions or report on these transactions and/or for any other purposes for which You may have granted FW the access to such Personal Data.
To provide You with a personalized experience on our Platform, such as providing You with content based on your interest and making navigation on our Platform easier.
Improve our Products and Service offerings for You.
To check and process/ facilitate Your requests submitted to FW for Products/ Services and/or instructions or requests received from You in respect of these Products/ services.
To share with You, updates on changes to the Products/ Services and their terms and conditions.
To provide you with transaction and post transaction- related services, providing, improving, and marketing our Products and Services, including site content and performance.
To take up or investigate any complaints/ claims/ disputes.
To respond to your queries or feedback submitted by You.
To verify your identity to provide Products/ Services to You.
To carry credit checks, screenings or due diligence checks as lawfully required by FW.
To monitor and review Services from time to time.
To undertake financial/ regulatory/ management reporting, and create and maintain various risk management models.
For conducting audits and for record-keeping purposes.
For selective offers and promotions which We think You may find interesting.
To fulfill the requirements of applicable laws/regulations and/or court orders /public orders/ regulatory directives received by FW/protect and defend the rights or users of FW.
For any other matter incidental and associated to the above.

3.STOARGE & RETENTION OF YOUR DATA

You understand that Your data including Personal Data can be processed, transferred to, used and stored by data users/transferees referred to above, on servers that may be located outside of India.
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy and for effective provision of Services for which you have signed up on the website.
We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain data for internal analysis purposes as permissible by the applicable laws.
You may disable or delete Your Account at any point of time in accordance with the applicable Terms. With this, we will except as stated above, no longer share Your data with any third parties including Product Providers.

4. YOUR RIGHTS FOR DELETING, UPDATING & MODIFYING YOUR DATA

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.
You may at any time withdraw Your consent to process the Personal Data shared by You with FW and FW shall within reasonable time, after having received such withdrawal request from You, cease to process Your Personal Data, unless otherwise required as per the applicable law for the time being in force.
Our Service may give You the ability to delete certain information about You from within the Service.
You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your Personal Data. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.
Should you decide to withdraw Your consent to use/ process Personal Data entirely or a portion thereof, we may then review Our ability to provide our Service(s)/ any portion thereof to You and shall even be entitled to terminate / suspend Your Account with Us.
Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

5. YOUR LOGIN CREDENTIALS

While signing up for Your Account on the Platform, You will need to set a PIN or other authentication methods like password, biometrics or two-factor authentication. You acknowledge that it is Your sole responsibility to maintain the confidentiality of these credentials and ensure they remain secure. You are responsible for choosing strong and unique credentials, and for safeguarding them by logging out of the Platform when not in use, securing your devices, and taking necessary precautions to prevent unauthorized access. Any actions taken using your access credentials will be considered authorized by You, and Finhaat will not be liable for any loss or damage arising from your failure to secure Your Account.
Similarly, you shall also not access or use the credentials or accounts of any other user of Our Platform and also not disclose Your own credentials to any party. In case you choose to share Your information or Platform credentials with any third party, you are responsible for all actions taken with Your login credentials and any charges or costs or losses as may accrue to You.
In case your pin or login credentials are compromised, You may lose substantial control over Your Personal Data and may be subject to legally binding actions taken on Your behalf. Therefore, in such cases You should attempt to change Your pin immediately and notify Us as soon as practicable, if You suspect any consistent unauthorized use of Your Account or access to Your pin even after changing it.

The Platform may contain hyperlinks to other websites, content, or resources, including but not limited to sites owned by Our associate companies or developers or otherwise. Please note that these sites and resources are operated by parties other than FW, and we do not have control over any such websites or resources.
You agree and acknowledge that FW is not responsible for the availability of these external websites or resources and does not endorse any advertisements, products, or materials found on or obtained from these external sources.
You acknowledge and agree that We are not liable for any loss or damage which may be incurred by You as a result of the availability of those external sites or resources, or as a result of any reliance placed by You on the completeness, accuracy or existence of any advertising, or other materials on, or available from, such websites or resources. These third-party service providers and third-party sites may have their own privacy policies governing the storage and retention of your personal information that you may be subject to. We recommend that when You enter a third-party site, You review the third-party site’s Privacy Policy as it relates to safeguarding Your personal information. We use third-party advertising companies to serve ads when you visit the Platform.

We may update Our Privacy Policy from time to time.
We will update the "Last updated" date at the top of this Privacy Policy.
You are advised to review this Privacy Policy periodically for any changes.
Changes to this Privacy Policy are effective when they are posted on this page.
This Privacy Policy shall apply to the Platform.

By providing your specific consent and submitting Your Personal Data, You understand the above and hereby expressly grant Your unconditional consent to and authorize FW to act in accordance with purposes stated above including FW’s collection, receipt, usage, possession, storage, dealing, handling and disclosure of your Personal Data as set out in this Privacy Policy. Your consent shall be considered as free, specific, informed, unconditional and unambiguous and shall signify an acceptance/agreement to the use and processing of the Personal Data for the specified purpose.
